Il “diritto d’autore” è il diritto esclusivo di sfruttamento delle opere dell’ingegno di carattere creativo inteso sia sotto la figura dei diritti patrimoniali dell’autore, sia come diritti morali e soggettivi a tutela della personalità stessa dell’autore. La materia è principalmente regolata dalla legge speciale 22 aprile 1941, n. 633 e successive modificazioni e integrazioni. |

| What are "Related rights"? |

“Related rights” are those provided by the law not to the author of the work, but to other subjects that are however connected to the author.
The most important “related rights” are those provided to authors, performing artists and to producers of phonographic discs or similar media, to cinematographic or audio-visual works producers and to radio and television broadcasters.
Other related rights, with a lower degree of protection than copyright, are also those provided to authors (or publishers) with regard to creations that are not real “intellectual property”. This is the case of rights on photography, theatrical scenery sketches, critical editions of public domain works, works published after the expiry of copyright protection deadlines, etc. |

| What is a blank media tax or private copying levy, and who pays it? |

The blank media tax or “private copying” levy is charged for the benefit received by the consumer from the lawful right to legally reproduce, for personal use only, phonograms and audio-visual works, without having to request the prior authorization of authors, artists and producers, who are holders of autonomous exclusive reproduction rights. The fee consists in a percentage on the seller’s purchase price and on a fixed amount and is applicable to:
- all new dedicated recordable media, analogical e digital, (audio and video) suitable for recording phonograms and videograms (CD-R, CD-RW, DVD-R, DVD-RW, etc.);
- all recording devices, analogical and digital, suitable for recording phonograms and videograms on new media storage devices.
The fee must be paid by whoever manufactures or imports in the territory of the Italian State, for profit, recording devices and new media storage devices. |

| What does the SIAE stamp look like ? |

Over the years the SIAE stamp has undergone several changes making it difficult to falsify. The stamp presents the following features:
- once it is removed, it becomes unusable;
- it is metalized, so it cannot be photocopied nor scanned, and it contains anti-counterfeiting features that are invisible to the naked eye;
- the logo’s ink is thermo reactive, meaning that if heated, also if rubbed with the fingers, it changes color;
- in general it contains information about the title of the work, the producer’s name, type of device, type of marketing allowed, general progressive number, progressive number of the work. |

| On which devices are the stamps applied ? |

The copyright law provides that the stamps are to be applied to any storage device containing processing or multimedia devices, as well as any media storage device (CDs, audio and video cassettes, CD Roms, DVDs, etc.) containing sounds, voices or moving images, bearing the fixation of works or parts of works protected by copyright law destined to be marketed or transferred under any title for profit. |
